Terms of Service

1. Acceptance of terms

The Datero.md platform (hereinafter "the Platform") is operated by KERNEXIT S.R.L., IDNO 1026023040248, Chișinău, Republic of Moldova. By accessing and using the Platform, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use the Platform.

These terms are governed by the legislation of the Republic of Moldova, including the Civil Code of the Republic of Moldova and Law No. 284 of 22.07.2004 on electronic commerce.

2. Service description

Datero.md is a business information platform providing access to public data about companies registered in the Republic of Moldova. Services include:

• Search and viewing of company registration data
• Analysis of financial data (balance sheet, revenue, profit) from public reports
• Information about public procurements from the MTender system
• Comparison tools, bulk verification, and market analysis

Information presented on the Platform is for informational purposes only and does not constitute legal, financial, or tax advice. Data comes from public registries and may contain delays in updates.

3. User account

To access certain features of the Platform, it may be necessary to create an account. By creating an account, you agree to:

• Provide accurate and up-to-date information
• Maintain the confidentiality of your login credentials
• Immediately notify Datero.md of any unauthorized use of your account

4. Data usage

Data available on the Platform comes from public registries of the Republic of Moldova. Use of this data is subject to the following rules:

• Data may be used for legitimate business, research, and analytical purposes
• Mass redistribution or resale of data without written consent of Datero.md is prohibited
• Automated use (scraping, bots) without prior authorization is prohibited
• Use of data for illegal, discriminatory, or fraudulent purposes is strictly prohibited

5. Intellectual property

The Datero.md platform, including the design, source code, analysis algorithms, trust scores, and database structure, is the intellectual property of Datero.md, protected by the legislation of the Republic of Moldova and international treaties.

Aggregated public data on the Platform remains in the public domain. Intellectual property rights refer to the way this data is organized, presented, and analyzed.

6. Limitation of liability

In accordance with Law No. 105 of 13.03.2003 on consumer protection, Datero.md makes reasonable efforts to ensure data accuracy. However:

• Datero.md does not guarantee the accuracy, completeness, or timeliness of presented data, as it depends on original public sources
• Datero.md is not responsible for decisions made based on information from the Platform
• Datero.md liability is limited to the value of the subscription paid by the user in the last 12 months

7. Modification of terms

Datero.md reserves the right to modify these terms at any time. Changes will be published on this page with the update date. Continued use of the Platform after publication of changes constitutes acceptance of the new terms. For substantial changes, we will notify registered users by email.

8. Applicable legislation

These terms are governed by the legislation of the Republic of Moldova. The applicable legal framework includes:

• Civil Code of the Republic of Moldova
• Law No. 284 of 22.07.2004 on electronic commerce
• Law No. 105 of 13.03.2003 on consumer protection

Any dispute will be resolved by the competent courts of the Republic of Moldova, located in Chisinau.

9. Personal data protection

Personal data is processed in accordance with Law No. 195/2024 on personal data protection. By creating an account you accept these terms and acknowledge the privacy policy. Cookies that are not strictly necessary are enabled only with your explicit consent, which you can withdraw at any time via "Cookie settings". Full information on the data processed, legal bases, retention periods and your rights is available in the Privacy Policy.

11. Orders, prices and payment methods

The service is sold as a subscription (Pro and Business plans) for 1 or 12 months. Prices are shown on the Pricing page in Moldovan lei (MDL) and include all applicable taxes. KERNEXIT S.R.L. is not a VAT payer.

• Orders are placed from the user account on the Pricing page by choosing a plan and a period. Before paying, the user confirms the order and accepts these Terms and Conditions.
• Card payments (Visa, Mastercard) are processed by the maib e-Commerce service of BC "Moldova Agroindbank" S.A. Card details are entered only on the bank's secure page and never reach KERNEXIT S.R.L.
• Bank transfers are made against a proforma issued from the account, valid for 7 days; bank fees are borne by the payer.
• Once payment is received, the user gets a payment confirmation and the invoice (PDF) by e-mail, with the order number, amount, date and subscription description. The documents stay available in the account under Payments.

The subscription does not renew automatically. When it expires, the account returns to the Free plan; a new period can be purchased at any time.

12. Delivery (activation) of the service

The service is digital and delivered electronically: the paid plan is activated in the user account immediately after the card payment is confirmed (usually within seconds) or on the day a bank transfer is received. There is no physical delivery.

The subscription period runs from the activation date. Access is provided through datero.md and the API, within the limits of each plan described on the Pricing page.

13. Refund (return) policy

Because the service is digital and activates immediately, the following rules apply:

• Full refund on request within 14 days of payment if no paid-plan data was accessed in that time (history, extended financials, exports, API calls beyond the Free limit).
• Payments made in error (duplicates, wrong amount) are refunded in full. Refunds go back to the same card or account used for payment within 10 business days of approval; crediting time depends on the issuing bank.
